Terms of service

These terms are an agreement between you and PixelPulse Media LLC, a Wyoming limited liability company (“SendPath”, “we”, “us”), which operates the SendPath service at sendpath.ai and app.sendpath.ai. By creating an account or using the service you agree to them. If you use SendPath for a company, you confirm you may bind it, and “you” means that company.
Our Acceptable use policy and Privacy policy are part of these terms.
1. What SendPath is
SendPath is software for sending email campaigns from mailboxes you already own, to contact lists you already have. You connect your own mailboxes (for example over SMTP and IMAP), or your own account at an email-sending service such as Resend or Amazon SES; messages are sent from them, not from our servers. We don’t provide mailboxes, sending infrastructure, or contact lists, and we don’t sell or supply leads.
Before anything is sent, SendPath runs checks on every campaign and every message: address verification, your suppression list, sender health, and template rules such as a working unsubscribe link and your postal address. A message that fails a check is not sent. These checks reduce risk; they don’t guarantee that mail is delivered, read, or lawful in every case.
Warm-up is optional and per mailbox, and off until you turn it on. It sends short warm-up emails from that mailbox only to SendPath’s own seed mailboxes - never to other customers’ mailboxes and never to your contacts. Where you allow it, the seeds reply to a private address of your mailbox, and a mail filter SendPath creates in your mailbox files those replies away, read, so warm-up mail does not appear in your inbox; SendPath also moves any warm-up email it finds there into that folder. Warm-up sends count toward the mailbox’s daily cap, and it improves the odds of reaching the inbox without guaranteeing it.
2. Accounts and workspaces
- You must give accurate information and keep your sign-in details secure. You are responsible for everything done under your account.
- Each workspace has an owner, who controls billing, members and deletion, and may add operators. The owner is responsible for the people they invite.
- You must be at least 18 and use SendPath for business purposes, not as a consumer.
- Tell us promptly at support@sendpath.ai if you think your account has been compromised.
3. Your responsibilities for what you send
You are the sender of every email sent through SendPath, and you are responsible for it and for the lists you use. In particular, you must:
- have a lawful basis (such as consent, or a legitimate business interest where the law allows it) to email every contact you import;
- comply with the email and privacy laws that apply to you and your recipients, including CAN-SPAM in the United States, GDPR and the ePrivacy rules in the EU and UK, and CASL in Canada;
- identify yourself honestly as the sender, include your valid postal address, and honor unsubscribe requests (SendPath adds a one-click unsubscribe link and suppresses the address automatically);
- follow the terms of your mailbox providers, which may be stricter than ours;
- follow our Acceptable use policy.
4. Your data
You keep all rights to the contacts, templates and other content you put into SendPath (“your data”). You give us permission to store and process your data only as needed to provide, secure and support the service, as described in our Privacy policy. For personal data in your contact lists, you are the controller and we act as your processor.
Mailbox passwords, sending-service API keys and similar credentials are stored encrypted and are used only to send, test connections, and read replies and bounces for you. Our staff cannot read them.
5. AI features
Some features use AI, such as labelling replies (for example Interested or Unsubscribe) and reviewing templates. AI output is advisory and can be wrong; you can change any label. A reply labelled as an unsubscribe request suppresses that address. SendPath never sends a message on its own in response to a reply from your contacts; the only automatic replies are warm-up emails, if you turn warm-up on.
6. Free trial, plans and billing
- Every workspace starts with a 14-day free trial, with no card required and up to 1,000 emails. When the trial ends without a paid plan, the workspace becomes read-only.
- Paid plans are subscriptions billed in advance, monthly or yearly, through our payment processor, Stripe. They renew automatically at the end of each period until cancelled.
- Each plan includes limits, such as emails per month, stored contacts and verifications per month. When a limit is reached, the related action stops until the next period or an upgrade.
- Verification credits are one-time purchases that check one address each once a plan's monthly verifications are used. They never expire while the workspace exists, belong to the workspace that bought them, can't be moved to another workspace, and are lost if the workspace is deleted. They need an active plan or trial to be used.
- If you choose a plan during your trial, your card is saved and first charged when the trial would have ended.
- Prices are in US dollars and exclude taxes, which are added where required. We may change prices with at least 30 days' notice; a change applies from your next renewal.
7. Cancellation and refunds
You can cancel at any time in Settings, under Manage billing. Your plan stays active until the end of the period you have paid for and does not renew.
Payments are non-refundable. We do not refund partial periods, unused allowances, unused credits or downgrades. The free trial is the way to try SendPath before paying. This does not affect any refund right that applicable law gives you and that cannot be waived.
8. Failed payments
If a payment fails, your workspace keeps working for 7 days while you update your card. After that it becomes read-only: sending stops and campaigns pause, but nothing is deleted, and paying restores it.
9. Suspension and termination
We may pause sending, set a workspace to read-only, or suspend or close an account if you breach these terms or the Acceptable use policy, if your sending causes high bounce or complaint rates or abuse reports, if the law requires it, or to protect the service, our providers or recipients. Where practical we will tell you first and give you a chance to fix the problem.
You can stop using SendPath at any time. The workspace owner can delete a workspace in Settings once any subscription is cancelled; deletion permanently removes its data and destroys its stored credentials.
10. Third-party services
SendPath relies on third parties, including Google Cloud for hosting and AI, Stripe for payments, and the mailbox providers and sending services you connect. Their availability and terms are outside our control, and your use of your own mailboxes is governed by your agreements with those providers.
11. Disclaimers
SendPath is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the service will be uninterrupted or error-free, or that any email will be delivered, reach an inbox, or produce any result.
12. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to SendPath is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
13. Indemnity
You will defend and indemnify PixelPulse Media LLC against claims, fines and costs (including reasonable legal fees) arising from the emails you send, the lists you use, or your breach of these terms or of the law.
14. Changes to these terms
We may update these terms. For material changes we will give at least 30 days’ notice by email or in the app. Continuing to use SendPath after changes take effect means you accept them.
15. Governing law
These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state and federal courts located in Wyoming, and both parties consent to their jurisdiction.
